1. General
- By accessing or using this website and the services offered by My Record Check ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use this website.
- Our services are intended for individuals who are at least the age of majority in their jurisdiction. This website is not directed to children under 13 years of age.
- We may revise these Terms at any time. Revised Terms are effective when posted to the website. Your continued use of the website constitutes acceptance of the updated Terms.
- These Terms apply to all visitors, users, and others who access or use the website.
2. Description of Service
- My Record Check provides name-based criminal record checks by searching publicly available Canadian police databases, including the Canadian Police Information Centre (CPIC). We are not a law enforcement agency and do not have direct access to sealed, expunged, or youth criminal justice records.
- Results are based on name and date of birth matching and may not reflect a complete or certified criminal history. A certified criminal record check requires the submission of fingerprints to the RCMP National Repository of Criminal Records.
- Our checks are not Vulnerable Sector Checks and may not be suitable for positions working with vulnerable populations. Please consult the applicable employer or regulatory authority for specific requirements.
- Our checks may not be suitable for immigration and VISA-related purposes without additional supporting documentation.
3. Permitted Use
- You may use our services only for lawful purposes and in accordance with these Terms.
- You agree not to: (a) upload or transmit any unlawful, harmful, or objectionable material; (b) attempt to gain unauthorized access to any part of the website; (c) use automated tools, bots, or scrapers to extract data; (d) reproduce, distribute, or create derivative works from any part of the website without our prior written consent; or (e) impersonate any person or entity.
- We reserve the right to suspend or terminate access to the website for any user whose conduct we reasonably believe violates these Terms or is otherwise harmful.
4. Identity Verification & Consent
- To process a background check, we require you to verify your identity. This may include remote identity verification using biometric data (facial image comparison against a government-issued ID). By submitting your biometric data, you consent to its collection, use, and storage as described in our Privacy Policy.
- You certify that all information you provide is true, accurate, and complete to the best of your knowledge. Providing false information is a violation of these Terms and may be unlawful.
- You consent to My Record Check and its partners searching applicable Canadian police databases using the information you provide in order to generate your report.
- You understand that by requesting a check, your results will be delivered to the email address you provide.
5. Payment & Refunds
- All purchases are processed securely. Prices are listed in Canadian dollars and include applicable taxes.
- Payments are final. A refund will only be issued if a report cannot be generated due to a technical failure on our part. Refund requests must be submitted to support@myrecordcheck.com within 7 days of purchase.
- We are not responsible for any errors or omissions resulting from inaccurate information provided by you during the order process.
6. Accuracy of Results
- Criminal record check results are based on name and date of birth matching against available databases. Records may be incomplete, delayed, or subject to judicial sealing or expungement. My Record Check does not guarantee the completeness or absolute accuracy of any report.
- We strongly recommend verifying any results through official government or law enforcement channels before making decisions based on the information provided.
- We are not liable for any decisions made by you or any third party based on the results of a background check.
7. Intellectual Property
- All content on this website, including text, graphics, logos, and software, is the property of My Record Check or its content suppliers and is protected by applicable Canadian and international intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable license to access and use the website for personal, non-commercial purposes only. Any other use requires our prior written consent.
8. Disclaimer of Warranties
- This website and its services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the website will be uninterrupted, error-free, or that results will be accurate or complete.
- Use of the internet for data transfer involves inherent security risks. While we implement industry-standard safeguards, no security measure is 100% effective.
9. Limitation of Liability
- To the fullest extent permitted by applicable law, My Record Check and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or related to your use of or inability to use this website or its services.
- Our total liability for any claim arising from these Terms or use of the service shall not exceed the amount paid by you in the 30 days prior to the event giving rise to such claim.
10. Indemnification
- You agree to indemnify, defend, and hold harmless My Record Check and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the website or services; (b) your violation of these Terms; or (c) your violation of any applicable law or regulation.
11. Governing Law
- These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
- Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
