2. Information We Collect
- Personal identification information: legal name (including middle name and maiden name), date of birth, sex, place of birth, and government-issued ID details.
- Contact information: email address, phone number, and residential address (including date of occupancy).
- Biometric data: facial images captured during identity verification, which are processed to confirm your identity against your government-issued ID.
- Payment information: credit card number, expiry date, and billing details. Payment information is processed by a PCI-DSS compliant third-party payment processor and is not stored on our servers.
- Usage data: IP address, browser type, operating system, pages visited, and session duration, collected automatically when you access our website.
- Self-disclosed information: any criminal conviction declarations you provide as part of the check application.
3. How We Use Your Information
- To process and fulfill your criminal record check request, including searching applicable Canadian police databases such as the Canadian Police Information Centre (CPIC).
- To verify your identity through remote biometric identity verification prior to submitting a check request.
- To deliver your results and related communications to the email address you provide.
- To send transactional emails including order confirmations, receipts, and support responses.
- To comply with our legal obligations, resolve disputes, and enforce our agreements.
- To improve our website and services through analysis of aggregated, anonymized usage data.
- With your optional consent, to send you promotional communications about our services. You may withdraw this consent at any time.
4. Biometric Data
- We collect facial image data solely for the purpose of confirming that the person ordering a background check is the same person shown on the government-issued ID provided.
- Biometric data is processed by our identity verification partner and is not used for any other purpose. It is retained only for as long as necessary to complete the verification process, after which it is securely deleted in accordance with our data retention policy.
- We do not sell, lease, or profit from your biometric data. We do not share it with any third party except as required to perform identity verification.
5. Disclosure of Your Information
- We do not sell your personal information to any third party.
- We may share your information with: (a) our identity verification partners for the purpose of confirming your identity; (b) our police database partners for the purpose of conducting the criminal record search; (c) payment processors for the purpose of processing your transaction; and (d) email delivery services for the purpose of sending you your results.
- All third-party partners are bound by confidentiality agreements and are prohibited from using your data for any purpose other than the service they provide to us.
- We may disclose your information if required to do so by law, court order, or at the request of a government or regulatory authority.
6. Data Retention
- We retain your personal information for as long as your account is active or as needed to provide you with our services.
- Background check records and associated personal data are retained for a period of 12 months following your order date, after which they are securely deleted.
- Biometric data is deleted immediately following successful identity verification.
- You may request deletion of your personal data at any time by contacting us at privacy@myrecordcheck.com. We will respond within 30 days.
7. Data Security
- We implement industry-standard security measures to protect your personal information, including 256-bit SSL/TLS encryption for all data transmitted between your browser and our servers.
- Access to personal data is restricted to authorized personnel on a need-to-know basis. All staff with access to personal data are subject to confidentiality obligations.
- While we take all reasonable precautions, no transmission over the internet or electronic storage method is 100% secure. We cannot guarantee absolute security.
- In the event of a data breach that poses a real risk of significant harm to you, we will notify you and the applicable privacy commissioner as required by law.
8. Your Rights
- Under PIPEDA and applicable provincial legislation, you have the right to: (a) access the personal information we hold about you; (b) request correction of inaccurate or incomplete information; (c) withdraw consent to the collection, use, or disclosure of your information (subject to legal or contractual restrictions); and (d) request deletion of your personal information, subject to our legal obligations.

- You can disable cookies through your browser settings. Disabling cookies may affect the functionality of certain parts of our website.
- We do not use cookies to track your activity across third-party websites.
